Prevention and Control of Animal Cruelty in Ahmedabad City Policy- 2023

Key points of the proposed new policy.
(A) Permit and License:-
A livestock owner who keeps livestock for personal use at home will have to obtain a permit. – If the livestock owners keep livestock for sale of milk or use the livestock in any other way commercially, they will have to obtain a license.
- The period of the license will be for three years from the date of implementation of the policy.
The license fee for three years will be Rs. 500/- and the permit fee will be Rs. 250-.
The license-permit will have to be renewed one month before the expiry of the period.
(Rs. 500/- for license and Rs. 250- for permit) After the expiry of the period, Rs. 100- per month will have to be paid as late fee.
Every animal husbandry farmer will have to pay a registration fee of Rs. 200 per animal.
Institutions like Panjrapol Gaushala which are registered under the Public Charitable Trust Act or recognized by such government body will have to obtain a license, and such institutions will have to be exempted from the license fee and permit fee.

(B) For cattle owners with RFID chip and tag space:
-If the cattle breeder brings new cattle from outside the city, he will have to complete the process of registering the cattle, attaching RFID chip and tag and obtaining permit license within one month. Every cattle living in the city will have to be attached with RFID chip and tag.
The remaining work of attaching RFID chip and tag to the cattle will have to be done within a maximum of 2 months by paying Rs. 200 per animal and after 2 months, a charge of Rs. 1000 per animal will be collected and if the cattle is still pending to be attached with RFID chip and tag after 4 months from the date of implementation of the policy, it will be caught and put in a cattle box. It will not be released under any circumstances. These cattle will be sent out of the city.
If the tag is broken for any reason, a charge of Rs. 500 will be charged and the cattle will be released after charging fine, food charge and administrative charge.
For animal owners who do not have a place:
Animal owners will have to move the animal away from the city limits at their own expense within a specified time (maximum 2 months).
(C) License for selling grass:
Any person or organization in the city will have to obtain a license permission for selling grass and will have to maintain a register record regarding where the grass was brought from and to whom it was sold.
Responsibility of the animal owner and action against him:
All responsibility regarding stray animals will remain with the animal owner.
If a stray animal causes loss of life or property to a citizen pedestrian, then action can be taken against the owner through civil criminal proceedings and compensation and compensation claim can be recovered from him.
If the cattle is caught for the first time, then as mentioned above, if caught for the second time, the fine will be one and a half times, and if caught for the third time, the fine (feed charge and administrative charge) will be doubled, and if different cattle of the same owner are caught three or more times, the cattle will be permanently confiscated and the cattle will not be returned and the license permit of the cattle owner will be canceled, after which that person will not be able to keep the cattle.

(E) Provisions made in section 376 of the GPMC Act 1949, – As per the Schedule Chapter- 14 Rules 22 of the GPMC Act 1949, it shall be mandatory for any animal owner to obtain a permit for keeping animals in the city. Without obtaining a permit, he shall not be able to keep animals in the city. As per section 376 of the GPMC Act 1949, any business or activity of keeping, selling, selling milk or for any other purpose shall be carried out in the city by obtaining a license. Otherwise, such activity shall not be carried out.
For keeping dairy animals on the premises having a license permit, it shall be mandatory to obtain a separate license as per section 376(1) of the GPMC Act 1949.
The animal owner shall obtain a permit license for keeping animals in the city and a license for keeping dairy animals within 90 days from the date of publication of the notification.
(F) Procedure regarding confiscated cattle and cattle not released by the animal owners: (1) To send dairy animals outside Ahmedabad city through auction.
Regarding the sale of cattle through auction, the Sta.K.Th.No.2003 dated 1402 1969 has been approved.
Dairy, agricultural or otherwise useful animals shall be sold to the beneficiaries of villages outside the city through public auction. A committee shall be formed to decide the base price for the public auction.
(2) To provide calves and bulls to the needy farmers. (Free of cost at a fixed price) > Free of cost:
According to the circular of the Board of Agriculture and Cooperation Department, Animal Husbandry Department, Cow Service-Gouchar Department etc., the approved implementing agencies, as per the circular of the Cooperative Department Board, who are holding land within 50 km from the limits of Ahmedabad city, will have to create a new system to transport and hand over calves, bulls etc. to the needy farmers at their own expense.
The organization recognized by the Agriculture and Cooperation Department, Animal Husbandry Department, Cow Service-Gouchar Department etc. of the State Government will have to create a new system to take such animals from the cattle pond and hand over the animals to the farmers they ask for at a fixed charge.
(3) Sending the animals to an institution like Panjarapo.
At present, approximately more than 80% of the animals caught on a daily basis are not released. In contrast, the capacity of the cattle box is limited, so the cattle are sent to the Panjrapol through Mumbai Jivdaya Mandali. In view of this, the cattle that can be sold through auction, the remaining cattle will have to be sold to an institution like Panjrapol.
(4) After the State Government allocates grazing land, an animal hostel will be built and the cattle will be sent there.
After the AMU gets grazing land in an area far from the urban limits with the help of the State Government, it will be planned to start an animal hostel there with the help of the relevant government department.
The animal hostel will have to be made operational by getting full and partial financial assistance from the State Government for the capital cost and its repair and maintenance expenses.
For the management of the hostel, an MOU will be made with the Animal Husbandry or Cow Service Department of the State Government and appropriate action will be taken to ensure that the maintenance is done through them.
(G) Other issues:-
- Planning to build new, modern, smart, more convenient cattle ponds in each zone based on the number of cattle in each zone.
- Like the “Friends of Zoo” scheme, the “Friends of Cattle” scheme will be launched. Any person will be able to deposit money for fodder at any city civic center and get access. The corporation will use this amount for fodder. So that the religious sentiments of the people will also be preserved and they will not feed the cattle on the road.
- On the day of religious festivals, the citizens will be able to feed the cattle by coming to the cattle shed.
- Mapping on the map based on the registration of cattle habitation places will have to be done by the CNCD department.
- An Animal Helpline will be launched by the Municipal Corporation to address the issues of animal owners, such as animal health, animal maintenance and care, vaccination, etc. Where adequate guidance will be provided to the animal owners and IEC activities will be conducted from time to time.
